Please read terms and conditions before using our services
1. Your initial retainer of 50% reserves your event date and is non-refundable.
2. Balance must be received at least 7 days prior to event date or contract is null and void, and retainer will not be refunded.
3. The date of your final payment is the final date for any changes of size, style, or flavors of the cake. Any changes requested after this date cannot be made. Changes may be subject to additional fees due by final balance due date.
4. If you must change your date, payment in full is required before the new date is accepted and is subject to availability. Date cannot be more than 6 months out and no refund will be issued if date is unavailable.
5. We are not obligated to accept a date change if we are booked for the new date or are unavailable.
6. NO refunds will be issued under any circumstances, unless Say It With Cake chooses to cancel your order. If that occurs, you will receive only your retainer as a refund within 30 days of cancellation.
7. In the event of cancellation by customer, payments and retainers are NON-REFUNDABLE and WILL NOT be issued under any circumstances.
8. Delivery and set up fee (if applicable) are included in total invoice.
9. If delivery is requested on the day of event, to you not being able to pick up the cake as agreed, your cake may not be delivered on time and is subject to availability. The delivery fee will be expected before the cake leaves the shop.
10. If you are picking up your cake and the cake is not picked up within a 30-minute window from the set pick up time, you may not be able to pick up your cake until the following business day due to other cake obligations or deliveries.
11. If we deliver cake, we are not responsible for any damage to the cake after setup is complete. You are responsible for providing an appropriate and secure table and environment for the cake(s). Cakes are heavy and require a sturdy table, and optimal room temperature of 70 degrees Fahrenheit or below. Space for cake needs to be set up and ready for cake prior to delivery. Say It With Cake cannot wait for spot to be made ready for cake.
12. Please note, cakes should not be left outside for more than 20 minutes. Say It With Cake is not responsible for damages such as melting, bug infestation, or damaging occurrences preventing safe consumption, if customer requests outdoor setup.
13. It is your responsibility to ensure that the event location is open and available for setup at the appointment time. Should we have to wait at the site for the event space to be opened, you will be billed for the time at $25 per 15 minutes that must be paid before the cake is set up.
14. If you or your representative elect to pick up and set up the cake, you assume all responsibility and liability for the cake once it leaves our possession and we are no longer responsible.
15. All cakes delivered must set out for 2 hours prior to event. If we deliver the cake and there is no place to set up and your cake is placed elsewhere i.e. a refrigerator, when you cut into your cake and it’s still cold/frozen, this is not our responsibility due to the fact that the cake did not set out for the 2 hours needed to come to room temperature.
16. DO NOT SMASH CAKES OR TREATS INTO ANYONES FACE due to stiffness of buttercream and possible dowls inside cake for structure supports. WE ARE NOT responsible for bodily injury/damages caused by such acts.
17. We photograph all our cakes and reserve the right to use the photographs for display or promotional purposes without compensation to you. Photos will not ne posted until after cake is received by customer.
18. Our products may contain or come into contact with milk, wheat, nuts, soy, and other allergens. You agree to notify your guests of this risk and hold us harmless for allergic reactions.
19. Client gives some degree of artistic license concerning cake design. Client understands that cake(s) will be closest to the representation agreed upon but not exact.
20. All sales are final. Orders requesting a refund after orders are delivered must return all uneaten portions of the product purchased for evaluation, for credit (if any) towards future purchases to be used within 60 days of the order due date.
21. Performance of this agreement is contingent upon our ability to complete the agreement and is subject to labor disputes or strikes, accidents, Acts of Gods, and other causes beyond our control.
22. We reserve the right to refuse service to anyone.
